If your dispute hasn't been resolved through conciliation or settlement, the next step is submitting a tribunal claim. This is where formal preparation begins.
What happens at this stage
Submit your ET1 form
The ET1 is the official claim form submitted to the employment tribunal. It sets out who you are, who your employer is, and what your claim is about.
Your employer responds (ET3)
Your employer has 28 days to respond to your claim with their ET3 form, setting out their defence.
Case management
The tribunal may hold a preliminary hearing to set directions - deadlines for documents, witness statements, and the hearing date.

What's the time limit for submitting a claim?
Most claims must be submitted within 3 months minus 1 day of the event (or last in a series of events) (this is expected to increase to 6 months from October 2026). The ACAS conciliation period may extend this - check your specific estimated dates.
Is there a fee?
There is currently no fee to submit an employment tribunal claim in England, Wales, and Scotland.
Do I need a solicitor for tribunal?
