Dealing with a tribunal decision?
After a tribunal judgment, you may need to enforce it, or you may want to understand your options if the outcome wasn't what you hoped for.
What happens at this stage
Understand the judgment
The tribunal's written judgment explains what they decided and why. Understanding the reasoning is important whether you won or lost.
Enforcement if your employer doesn't pay
If the tribunal awarded compensation and your employer doesn't pay, you can take enforcement action through the courts.
Consider whether to appeal
You can only appeal on a point of law - for example, if the tribunal misapplied the law, made a procedurally unfair decision, or reached a conclusion that no reasonable tribunal could have reached. You cannot appeal simply because you disagree with their assessment of the facts. The Employment Appeal Tribunal handles appeals.
Understand time limits
You have 42 days from the date the written judgment was sent to submit an appeal. This is a strict deadline.
Common questions at this stage
What if my employer won't pay the compensation?
You can apply to the county court for enforcement, or use ACAS's enforcement scheme. There are specific steps depending on your situation.
Can I appeal if I lost?
You can only appeal on a point of law - for example, if the tribunal misapplied the law, made a procedurally unfair decision, or reached a conclusion that no reasonable tribunal could have reached. You cannot appeal simply because you disagree with their assessment of the facts.
Do I need a solicitor for an appeal?
Appeals are legally complex. While you can represent yourself, professional legal advice is strongly recommended at this stage.
